Fablyos: Terms of Service & Privacy Policy

1. Agreement; Definitions

1.1 These Terms of Service and Privacy Policy (the "Terms") form a binding agreement between you ("you" or the "User") and the operator of Fablyos ("Fablyos," "we," "us" or the "Operator") governing your access to and use of the Fablyos website, software and related services (the "Service"). By creating an account, or by accessing or using the Service, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

1.2 In these Terms: "Content" means any text, image, data or other material; "User Content" means Content that you submit to the Service, including actions, dialogue, character descriptions, world-builder answers and reference pictures; "Generated Content" means Content produced by or through the Service in response to User Content, including story passages, characters ("cards"), worlds, maps and pictures; "Content Level" means the General, Teen, Mature or Explicit setting that governs the Content permitted in a story or world; and "Third-Party Providers" means the independent service providers identified in Section 7.

1.3 The Service is presently offered on an invitation-only basis, without charge, for non-commercial testing purposes only. It is pre-release software and may change, be interrupted or be discontinued at any time without notice.

2. Eligibility and Accounts

2.1 Age. You must be at least thirteen (13) years of age to use the Service. Users aged thirteen (13) through seventeen (17) are restricted to the Teen Content Level or below, without exception. The Mature and Explicit Content Levels are available only to Users who affirm that they are eighteen (18) years of age or older (or the age of majority in their jurisdiction, if higher) and only where the Operator has enabled such levels for the account.

2.2 Accuracy. You represent and warrant that the age you affirm is true and accurate. Any misstatement of age is a material breach of these Terms and grounds for immediate termination.

2.3 Account Security. Accounts are personal and non-transferable. You are responsible for maintaining the confidentiality of your credentials and for all activity occurring under your account, and you shall promptly notify the Operator of any unauthorized use.

3. Prohibited Content

3.1 Absolute Prohibitions. Irrespective of Content Level, account type, privacy setting or any purported fictional, artistic, historical or other context, you shall not submit, request, generate, solicit, store or distribute through the Service, and the Service will refuse to produce, any of the following, in text or images:

3.2 Restricted Categories. The following are prohibited in all pictures, in all Content that is shared with or visible to any other person, and in all story text except as permitted by Section 3.4:

3.3 Construction. For the purposes of Sections 3.1 and 3.2:

3.4 Private Stories. A User who has affirmed that they are an adult, whose account the Operator has enabled for the Explicit Content Level, may enable "Unrestricted themes" for an individual story that is set to Explicit and is not shared with or visible to any other person. While so enabled, the categories in Section 3.2 are permitted in that story's text only, as fiction. This setting never applies to pictures, never relaxes Section 3.1, and is disabled automatically, without notice, if the story becomes shared with or visible to any other person in any manner, whereupon the full prohibitions of Section 3.2 apply to it again. Content generated under this setting remains subject to applicable law and may not be distributed in violation of these Terms.

3.5 Clarifications. Sapient, adult, humanoid fictional characters (including, without limitation, beastkin, lamia, and shapeshifters in human or hybrid form) are treated as persons and not animals, provided they are adults in both stated age and depicted appearance. Sections 3.1 and 3.2 concern sexual Content; stories may otherwise include villains, historical or fictional wrongdoing, slavery, magic and combat.

3.6 Circumvention. You shall not attempt to evade, disable, test or circumvent any safety system of the Service, including by rephrasing, encoding, translation, role-play framing or instructions directed at the AI, nor use the Service as a general-purpose AI system for purposes other than interactive fiction.

4. Content Moderation and Enforcement

4.1 Automated Review. All User Content, all Generated Content, and all picture requests and pictures are subject to automated review prior to display, by means that may include pattern matching, the moderation services of Third-Party Providers, and AI classification in any language. You acknowledge that such systems are imperfect and may block lawful Content; the Operator has no obligation to permit any particular Content.

4.2 Blocked Content. Content that fails review is discarded and is not stored. The Operator retains only a record that a block occurred, consisting of the time, the account, the story, the category of the block and numerical classifier scores.

4.3 Strikes; Termination. Attempts involving minors constitute strikes. Three (3) strikes within any thirty (30) day period will result in automatic suspension of the account. The Operator may suspend or terminate any account, and remove any Content, at any time and for any reason, including any breach or suspected breach of these Terms, with or without notice.

4.4 Legal Reporting. Notwithstanding any other provision of these Terms, the Operator will comply with all applicable legal obligations, including any obligation to report apparent child sexual abuse material to the National Center for Missing & Exploited Children pursuant to 18 U.S.C. § 2258A, and will cooperate with lawful requests from law enforcement.

5. User Content, Generated Content and Licenses

5.1 Your Content. As between you and the Operator, you retain whatever rights you hold in your User Content. You grant the Operator a non-exclusive, worldwide, royalty-free license to host, process, transmit and display your User Content solely as necessary to operate, secure and improve the Service and to comply with law.

5.2 Generated Content. To the extent the Operator holds any rights in Generated Content produced for you, the Operator assigns such rights to you, subject to the rights of others in shared worlds (Section 6) and to the terms of the Third-Party Providers. Generated Content may not be unique, and similar Content may be generated for others. The Operator makes no representation that Generated Content is protectable by copyright.

5.3 Your Warranties. You represent and warrant that you have all rights necessary to submit your User Content, including any reference pictures, and that your User Content and your use of the Service comply with these Terms and applicable law. You shall not upload pictures of real persons without their consent.

5.4 No Training. The Operator does not sell your data, does not display advertising, and does not use your stories to train AI models.

6. Worlds and Sharing

6.1 Default Sharing. Worlds you build are shared by default. Unless you deselect "Share" when building, or withdraw sharing later, a copy of the world's cards is added to a catalog available to all accounts on the Service. General worlds are copied as built; Teen, Mature and Explicit worlds are shared only as a Teen-level copy rewritten by AI. Your world-builder answers and your stories are never shared.

6.2 License to Other Users. By sharing a world, you grant every other User of the Service a non-exclusive, royalty-free, perpetual license to use, play, copy, modify and download the shared copy within and from the Service. Copies, stories and downloads made before you withdraw sharing may be retained by those Users.

6.3 Attribution; Removal. You may elect to have a shared copy attributed to your username or presented anonymously. Shared copies are visible within the Service, and the Operator may review and remove them. You shall share only material you created or are entitled to share. Worlds you do not share are private on the same terms as your stories.

7. Privacy

7.1 Data Collected. The Operator stores: your username; a salted, hashed password; your age affirmation (adult or teen; not your date of birth); your acceptance of these Terms; login records; usage and spending totals; safety and security logs as described in Section 4; and your stories, save points and worlds until you delete them.

7.2 Confidentiality of Stories; Encryption. Your stories, save points, worlds you do not share, and pictures are private to you. They are stored encrypted with keys that only your password (or your recovery code) can unlock; the keys needed to read them are held in the Service's memory only while you are signed in, and are never written to disk. The Operator cannot read your stored stories, and its administrative tools display only metadata (such as content level, number of passages, size and costs). While you play, your text is necessarily processed in memory by the Service and the Third-Party Providers in Section 7.5 in order to write and check it. World maps generated from worlds with location data (geography and place names) are stored unencrypted.

7.2a Recovery Code. When encryption is set up for your account you are shown a recovery code once. If you forget your password, or if the Operator resets it at your request, your stories can be unlocked only with that recovery code. If both your password and your recovery code are lost, your encrypted stories and worlds cannot be recovered by anyone, including the Operator, and may be deleted. You can generate a new recovery code at any time under Account.

7.3 Pictures. Generated pictures are not stored by the Service or retained at the image provider: once a picture passes review, it is delivered once to your browser and the Operator directs the image provider to delete its copy. Pictures are thereafter held only in your browser on your device, will not appear on your other devices, and are lost if you clear your browser's data. The image provider may retain a record of the request. The sole exceptions are one small cover picture per story, retained only if suitable for the Teen Content Level, and world map paintings.

7.4 Explicit Pictures. Explicit pictures are available only to accounts of affirmed adults on which the Operator has enabled them, only in stories set to Explicit, and only after each picture passes an automated age-assurance check confirming that every person depicted appears to be an adult. Pictures failing that check are discarded. The picture's address or data is transmitted to the age-assurance provider for that purpose.

7.5 Third-Party Providers. To generate and review Content, the Service transmits the necessary text and pictures to: OpenRouter and the model providers to which it routes requests (story text, and AI classification of sexual Content); Wiro (pictures); OpenAI (moderation); and Hive (age assurance for explicit pictures). Such processing is governed by those providers' own terms and privacy policies, over which the Operator has no control.

7.6 Location. The Service is hosted in the United States, where your account, stories and worlds are stored. By using the Service, you consent to the transfer and processing of your data in the United States.

7.7 Deletion. You may delete any story, or your entire account, at any time from the Library. Deletion is permanent and removes your stories, save points, worlds (including their shared copies) and stored pictures. Spending, security and safety logs are retained, identified only by a numeric account identifier.

8. Usage Limits

The Operator may impose monthly usage allowances on any account. When an allowance is exhausted, pictures and world building may be suspended for the remainder of the calendar month while text generation continues; when a further limit is reached, all generation may be suspended until the following month. The Operator may restrict pictures or other features to particular accounts.

9. Disclaimer of Warranties

The Service and all Content are provided "as is" and "as available," without warranties of any kind, whether express, implied or statutory, including any warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability or freedom from error. The Operator does not warrant that the Service will be uninterrupted or secure, or that stories, pictures or other Content will be preserved. You are solely responsible for retaining copies of any Content you wish to keep.

10. Limitation of Liability

To the maximum extent permitted by law, the Operator shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, Content, profits or goodwill, arising out of or relating to the Service or these Terms, however caused and under any theory of liability, even if advised of the possibility of such damages. The Operator's aggregate liability arising out of or relating to the Service or these Terms shall not exceed the greater of (a) the amounts you paid to the Operator in the twelve (12) months preceding the claim, or (b) fifty U.S. dollars (US $50).

11. Indemnification

You shall indemnify, defend and hold harmless the Operator from and against any claims, liabilities, damages, losses and expenses, including reasonable attorneys' fees, arising out of or relating to your User Content, your use of the Service, or your breach of these Terms or of applicable law.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Texas and the federal laws of the United States, without regard to conflict-of-laws principles. Any action arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

The Operator may amend these Terms at any time. Amended Terms take effect upon publication, and you will be required to accept the amended version before continuing to use the Service. If you do not accept, you must cease use of the Service.

14. General

These Terms constitute the entire agreement between you and the Operator concerning the Service and supersede all prior understandings. If any provision is held unenforceable, it shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect. No waiver of any provision shall be deemed a further or continuing waiver. You may not assign these Terms; the Operator may assign them without restriction. Sections 3, 4.4, 5, 6.2, 7.7 and 9 through 14 survive any termination.
